Melanie Finkel, with over 20 years of litigation experience, represents clients in commercial and civil disputes primarily in the area of real estate litigation including commercial mortgage foreclosures, construction loan disputes, lender liability claims, workouts and title disputes. Ms. Finkel has appeared in the state and federal trial and appeal courts in New York.

REPRESENTATIVE EXPERIENCE

  • Representation of major financial institutions in federal and state courts in successfully foreclosing on multimillion dollar mortgages involving commercial properties including apartment buildings and shopping centers; obtaining rent receiver orders, and successfully defending against lender liability claims and negotiating settlements and workouts.

  • Representation of lenders and owners in connection with real estate disputes including actions to quiet title.

  • Representation of lender in action involving the enforcement of multimillion dollar guaranty and defeated guarantors' lender liability claims and successfully argued guarantors were precluded from raising defenses which they failed to raise in prior out-of-state commercial foreclosure actions.
